Wetlands and the Section 404 permit
Next, a lesson. Section 404 of the Clean Water Act sets up a program to regulate the discharge of dredged or fill material into waters of the United States, including wetlands.
The activities it covers include fill for development, and water resource projects such as dams and levees. Individual permits are reviewed by the U.S.
Army Corps of Engineers. Three environmental red flags worth checking early on any site are wetlands, floodplain, and being next to a historic property.
